1. Acceptance of terms

By creating an account or using Our Track Record ("the Service"), you agree to these Terms of Service. If you do not agree, please do not use the Service.

2. What Our Track Record is

Our Track Record is a music gifting platform that allows registered users ("Curators") to:

  • Create personalised, password-protected album experiences
  • Attach voice intro recordings to individual tracks
  • Share those albums privately with recipients via a unique link and password

3. Your account

  • You must provide accurate information when creating your account
  • You are responsible for keeping your login credentials secure
  • You must be at least 13 years old to use the Service
  • One account per person — accounts are not transferable

4. Free tier and paid upgrades

Free tier includes:

  • Unlimited albums
  • Unlimited tracks per album
  • Up to 5 voice intros per album
  • 1 shared album at a time

Paid upgrades:

  • Single Album Upgrade — $8.99: unlocks unlimited voice intros and sharing for one album
  • Album Pack — $26.99: 5 upgrade credits at a discounted per-album rate

Payments are processed securely by Stripe. All sales are final. If you experience a technical issue preventing access to a paid feature, contact us and we will resolve it.

5. Voice recordings

By recording a voice intro within the Service:

  • You confirm you have the right to record and share that audio
  • You grant Our Track Record a limited licence to store and deliver that recording as part of your album to the recipient you specify
  • You understand that voice recordings are private and accessible only via your password-protected album link
  • You retain ownership of your voice recordings at all times

6. Music and YouTube content

Our Track Record integrates with YouTube to allow track search and playlist import. By using this feature:

  • You acknowledge that music content is owned by its respective rights holders
  • You agree to comply with YouTube's Terms of Service
  • Our Track Record does not host, download, or store audio files from YouTube
  • The Service is for personal, non-commercial gifting use only — not for public broadcast or redistribution of music

7. Acceptable use

You agree not to use Our Track Record to:

  • Upload or record content that is abusive, threatening, defamatory, or illegal
  • Attempt to access another user's account or album without authorisation
  • Use the Service for any commercial purpose beyond personal gifting
  • Reverse engineer, copy, or attempt to replicate the Service
  • Use automated tools to scrape, crawl, or interact with the Service

We reserve the right to suspend or terminate accounts that violate these terms.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

9. Intellectual property

All design, code, branding, and non-user-generated content on Our Track Record is owned by us. You may not reproduce, distribute, or create derivative works from any part of the Service without our written permission.

10. Disclaimers

The Service is provided "as is." We do not guarantee uninterrupted availability. Music content is dependent on YouTube's availability and we cannot guarantee that specific tracks will always be accessible.

11. Limitation of liability

To the maximum extent permitted by law, Our Track Record shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability to you shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Changes to these terms

We may update these Terms from time to time. Significant changes will be communicated by email or notice on the site. Continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.

13. Governing law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
